Abstract:

In this study, the crime is addressed in Article 280 of the Turkish Criminal Code No. 5237 "The non-crime of members of the health care profession". The second book of the Criminal Law is in the second part of the fourth part entitled "crimes against the nation and the state" entitled "crimes against the court" and the property number 765 is the correspondence of article 530 of the Turkish Criminal Law entitled "Courmü Informing Zühul". According to TCK no. 5237 m280, a member of the health care profession who does not report to the competent authorities a crime he has encountered with a sign during his office is punished with a prison penalty. The fact that there is no restriction on the crimes that will lead to the birth of the reporting obligation in the definition of the crime has led to the faces of the health professionals with a fairly extensive obligation. The investigation of the crime was discussed on the arrangement. What is the legal value protected by crime in this scope, who the concept of the health care professional must be held, also the state of the health care professional members in terms of crime, the meaning of the sign concept that indicates that the crime is committed, whether the documents and statements will be in this scope, whether the crime may be processed intentionally or not, the duty of the health care professional to keep the secret, the right to fear of recognition or the duty to treat the crime will be counted as the reasons why it is illegal in the crime, the internal relationship between the crimes that regulate the obligations similar to TCK m280.
