Abstract:

It is very common that tenants make renovations and changes on rental properties. Previously, the legal disputes regarding this issue was being solved pursuant to general provisions when The Turkish Code of Obligations numbered 818 was in force. However, prepared mainly considering Switzerland Code of Obligation's Article 260a, 321st Article of The Turkish Code of Obligations numbered 6098 has a special regularization on the subject. According to this, lessor's written consent is required for tenants to make renovations and changes on rental properties. Renovation and change concepts must be distinguished from similar actions of tenant. Unless otherwise is specified in a written document, lessor does not have a right to ask to get back the rental property as it used to be before changes and tenant can not ask for augmentation of value
