Abstract:

According to Frederic Bastiat, the state of law has become a corrupt and legitimate robbery mechanism with the help of the state. This approach is about the welfare state or in other words, social state. The way to expand social and economic rights is possible through taxation within the framework of legislative power. While this process means legal robbery and corruption for Bastiat, at the same time it is the corrupting the law. While law requires the establishment of justice, it becomes a means of providing benefits to some groups and this becomes legitimate under these laws. The liberal tradition regards this situation as the theft of private property and labor. The area of activity of the State should be limited to providing security and justice. The basic reason for the corruption of the law, in other words the legal robbery, is the lack of consciousness. Those who have the political power have two options: either stop this robbery or keep it going by being part of it. The preference requires a consciousness to stop this robbery. The legislator's area of activity should be limited to providing security and justice.
