Abstract:

The lease contract is a contract between the lessee and the lessor. In this contract, the lessee obtains the right to use the movable or immovable property of the lessor in return for a certain price. 299-378 of the Turkish Code of Obligations regulates the lease agreement in detail. The termination of the lease contract is extremely important in terms of lease law. Regarding the rents of housing and roofed workplaces, the legislator foresees some special expiration. One of them is regulated in the third paragraph of Article 352 of the Turkish Code of Obligations. If the lessee or his/her spouse has a home suitable for residence within the same district or municipality, the lessor may terminate the lease agreement.
