Abstract:

One of the most discussed topics of the new government system is the presidency processes taken by the president in the chief executive position. The presidency processes can be divided into two: individual processes and regulatory processes. The President’s regulatory procedures are divided into three: the President’s decrees (Council No. 104), the President’s decrees (Council No. 124) and the President’s other regulatory procedures (General, Guidelines, Communication, Principal Decisions, etc.). The study will first make explanations about these processes, and then the differences between them and other regulatory processes in the Turkish Law will try to determine the positions in the Norms Hierarchy. The study will also focus on the issue of judicial supervision of the processes carried out by the President in the context of the democratic new government system.
