5237 Sayılı Türk Ceza Kanunu’nun 99.maddesinde düzenlenen çocuk düşürtme suçu detaylı olarak incelendiğinde, birçok eksiklik ve çelişkiyiiçinde barındırdığı görülecektir. Bu suç tipi üzerinde yeteri kadar bilimsel çalışmanın yapılmamış olması, kanuni düzenlemede gebe kadının irade serbestisi ile ceninin gelecekteki yaşamının korunması arasında bir dengenin sağlanmamış olması gibi nedenlerin doğurduğu sıkıntılar, uygulamada ken-disini etkili bir şekilde göstermektedir. Bu çalışmamızda, çocuk düşürtme suçu ceza hukuku açısından incelenecektir. Bu kapsamda, suçun koruduğu hukuksal değer, suçun unsurları, şahsi cezasızlık sebebi, nitelikli halleri ve yaptırımı, tartışmalı olan hususlara değinilerek ele alınacaktır.
