Abstract:

Ombudsman institutions main function is to make decisions upon complaints in order to protect any person against maladministration and constituting good governance. In respect of content and subject of the decisions issued by the Ombudsman Institution of Turkiye, in particular that are socially and economically effective on large segment of the society has broad scale of influence in practice. Ombudsman Institution of Turkiye’s decisions which issued after meticulous researches and considering justice and equity, presents de lege ferenda in administrative executions and aside from jurisdiction, presents whether good administration principles has taken into effect or not by the administrative bodies. In this aspect, it can be accepted that Ombudsman Institution of Turkiye’s decisions create justice not only case by case but also for the ones who are in the domain of that specific decision’s application area. When taken into consideration we can argue that Ombudsman Institution of Turkiye’s decisions offer a comprehensive solutions from a broad perspective a due to the conflict subject.
