1982 Anayasanın 74. maddesinde 2010 yılında yapılan değişiklikle, Türkiye Büyük Millet Meclisi Başkanlığına bağlı olarak idarenin işleyişi ile ilgili şikâyetleri incelemek üzere Kamu Denetçiliği Kurumunun (KDK) kurulması öngörülmüş ve 2012 yılında, 6328 sayılı kanunla Kamu Denetçiliği Kurumu kurulmuştur. 6328 sayılı kanunun 1. ve 5. maddelerinde iyi yönetim ilkelerine genel olarak değinilmiştir. Kamu Denetçiliği Kurumu Kanununun Uygulanmasına İlişkin Usul ve Esaslar Hakkında Yönetmeliğin “iyi yönetim ilkeleri” başlıklı 6. maddesinde iyi yönetim ilkeleri; kanunlara uygunluk, ayrımcılığın önlenmesi, ölçülülük, yetkinin kötüye kullanılmaması, eşitlik, tarafsızlık, dürüstlük, nezaket, şeffaflık, hesap verilebilirlik, haklı beklentiye uygunluk, kazanılmış hakların korunması, dinlenilme hakkı, savunma hakkı, bilgi edinme hakkı, makul sürede karar verme, kararların gerekçeli olması, karara karşı başvuru yollarının gösterilmesi, kararın geciktirilmeksizin bildirilmesi, kişisel verilerin korunması olarak sayılmıştır. Madde metninden, iyi yönetim ilkelerinin bu sayılanlarla sınırlı olmadığı da görülmektedir. KDK, idarenin her türlü eylem ve işlemleri ile tutum ve davranışlarını insan haklarına dayalı adalet anlayışı içinde, hukuka ve hakkaniyete uygunluk yönlerinden incelemek, araştırmak ve idareye önerilerde bulunmakla görevli bir kurumdur. KDK kararları incelendiğinde idareye dönük şikâyetlerin değerlendirilmesinde birinci olarak KDK kanunda belirtilen hukuka ve hakkaniyete uygunluk ve ikinci olarak da KDK kanununun uygulama yönetmeliğinde belirtilen iyi yönetim ilkelerine uygunluk yönünden başvuruların incelendiği görülmektedir. Dolayısıyla, iyi yönetim ilkeleri, KDK’nınönemli denetim ölçütlerinden biridir. Bu çalışmada, KDK’nın kararlarında iyi yönetim ilkelerini nasıl yorumladığı, somut olaylara yaklaşımı ve kararları incelenmiştir.
With amendments made in Article 74 of the Constitution of 1982 in 2010, the establishment of the Public Audit Authority (KDK) for the examination of complaints related to the functioning of the administration, depending on the Presidency of the Greater National Assembly of Turkey, was planned and in 2012, the Public Audit Authority was established by Law No. 6328 . Article 1 and 5 of Law No. 6328 referred to the principles of good governance in general. Public Audit Authority on the Procedures and Principles of the Regulation on the Implementation of the Law "Good Governance Principles" Title 6. The principles of good governance are: compliance with the law, prevention of discrimination, measurability, non-use of authority, equality, neutrality, honesty, kindness, transparency, accountability, compliance with the fair expectation, protection of the rights gained, right to rest, right to defense, right to information, decision in a reasonable time, reasoning of decisions, indication of the methods of appeal against the decision, notification of the decision without delay, protection of personal data. The text of the article also shows that the principles of good governance are not limited to these countings. The KDK is an institution responsible for examining, investigating, and making recommendations to the administration of all acts and procedures and attitudes and behaviors based on human rights in the sense of justice, in terms of compliance with law and justice. When the decisions of the KDK are examined in the assessment of the complaints to the administration, it is seen that the applications are examined in the first place in terms of compliance with the law and legality specified in the KDK law and in the second place in terms of compliance with the principles of good management specified in the implementation of the KDK law. Therefore, the principles of good management are one of the key control criteria of the KDK. In this study, we have studied the approach and decisions to concrete events, how the KDK interpreted the principles of good governance in its decisions.
