Abstract:

This study examines the parliamentary proceedings of laws related to associations and sports which forms the basis of sports clubs since 1909. From 1909 until 26 April 2022, sports clubs were accountable tothe Ministry of the Interior and the Ministry of Youth and Sports under a dual registration and record system under the status of an association. After the Sports Clubs Law numbered 7405 and dated 26 April 2022 entered into force, they were brought solely under the Ministry of Youth and Sports, thereby becoming subject to the provisions of private law. Law number 7405, although covering all sports clubs, is a legal regulation aimed at, both by its reasoning and its content bringing order and discipline to football clubs that have unlimited spending and incur debt uncontrollably. However, the reactions of clubs and sports jurists demonstrate that this law has not been able to solve the aforementioned problems in football. This study, which is a compilation, provides an evaluation by taking higher management models in sports, criticisms of law number 7405 on clubs made in the Grand National Assembly of Turkey and, reactions of club representatives and jurists in relation to certain articles in the law into account. Reconciling with parties involved at the preparation stage of laws, which are the legal heritage of the state, and their compatibility with globally accepted sport management models will make the work of both the administration and sports clubs easier and will also provide the opportunity to create a national sports management model that is accepted by everyone. The purpose of this study is to analyse the historic development of laws on sports club and higher management of sports and to conduct an academic evaluation of their effectiveness.
