Öz Fıkhı insanın nihâî hedefini gerçekleştirmek üzere tasarlanmış bir araç olarak tasavvur etmeyi teklif eden bu çalışmada mezkur yaklaşımın tabi bir uzantısı olarak sözkonusu araç-amaç ilişkisine dikkat çekmek amaçlanmış, fıkıh ilminin varlık amacı, insanın varoluş amacı ekseninde ele alınmıştır. Makalede varlıktaki ortak gâye, gâyesel ilişkiler ve ortak nihâî amaç uğrunda varlığın örgütlenme tarzına dikkat çekilmiş ve fıkhın amaçlar hiyerarşisi içindeki yeri tespit edilmeye çalışılmıştır. Çalışmada “kişinin itikadi, ahlâkî ve davranışsal edimlerinin ölçüye uygunluğunu araştırma konusu yapan ilim dalı” olarak fıkhın erken devirlerdeki bu küllî anlamına vurgu yapılmış ve bu bağlamda fıkıh, özellikle insanın varlık amacı olarak marifet ve ubûdiyyetle gâyesel anlamdaki irtibatı bakımından konu edilmiştir. Sözü edilen ilişkiler ağı içinde fıkıh ve onu kuşatan üst yapı vasfıyla din, bu amaçları gerçekleştirmek için işlev gören araçlar olarak konumlandırılmıştır.

This study purposes to conceive fiqh as a tool that is designed to achieve the ultimate goal of human beings, and by extension, aims at drawing attention to the this tool-purpose relationship, thus considering the very purpose of the science of fiqh to be within the axis of the purpose of existence of mankind. The article points out to the common purpose in the universe, purposeful relationships therein, and the manner in which the universe is organized towards the common ultimate goal. It then makes an effort to determine the place of fiqh within the hierarchy of goals. The aim of the study is to emphasize the holistic meaning of fiqh, which was attached to it in the early ages which defined it as “the branch of science that studied the conformity of one's belief, morality and behaviors to the norms”. In this context, fiqh is particularly relevant in terms of man's connection to knowing (maʿrifah) Allah and serving (ʿubūdiyyah) Him, which constitute his existential purpose. Within this network of relations, fiqh and religion, the latter constituting a superstructure encompassing the former, are positioned as the means to accomplish these goals.
