Bu makalede insan davranışlarını araştırma konusu yapan bilim dalı sıfatıyla fıkıh, bir fıkıh kurumu olan mezhep ve onların bağlı bulunduğu üst yapı konumundaki din insanın bilişsel (fikrî), duyuşsal (ahlâkî), ve eylemsel (fiilî) edimlerinin nihâî amaçları durumundaki marifet ve ubûdiyyeti gerçekleştirmenin araçları olarak konumlandırılmıştır. Bu itibarla fıkıh bu çalışmada “amel ölçme bilgisi”, mezhep ise “amel ölçme aracı” olarak tasavvur edilmiş ve konu özellikle psikoloji ve sosyal psikolojide ölçme ve değerlendirme teknikleri ve ölçme araçlarıyla mukayeseli olarak tahlil edilmiştir. Makalenin konu örgüsü içinde kıyâs “ölçme faaliyeti” anlamında kullanılmış, mezhep ise bu faliyetin kendisi üzerinden gerçekleştirildiği amel ölçme aracını ifade etmek üzere tarafımızdan ihdâs edilen “amel-ölçer” kavramıyla tasvîr edilmiştir. Çalışmada kıyâsı şer’î delillerden biri olmaktan ziyâde “ölçme bilgisine sahip uzman fakîh tarafından kullanılan bir yöntem” olarak takdim eden usûlcülerin görüşleri mezkûr bakış açısını temellendirmek üzere kullanılmıştır.
In this article, the scientists who investigate human behavior are positioned as the means of achieving the merit and obedience in the state of the final objectives of the human (physical), sensual (ethical) and action (physical) actions. In this regard, the fiction was described as "middle measurement knowledge" in this study, while the fiction was described as "middle measurement tool" and the subject was evaluated comparatively with measurement and evaluation techniques and measurement tools, especially in psychology and social psychology. In the subject line of the article, it was used in the meaning of "measurement activity" and the philosophy was depicted with the concept of "action-measurement" offered by us to express the action measurement tool that this philosophy is performed through itself. In the study, the opinions of the prosecutors who presented as a "methode used by the expert with measurement knowledge" instead of being one of the evidence of the sheriff were used to establish the perspective of the mosquito.
