Haddler Allâh hakkı olarak yerine getirilmesi gereken ve miktarı şâri‘ tarafından belirlenmiş cezalardır. İçki içme cezası da cumhuru oluşturan Hanefîler, Şâfi‘îler, Mâlikîler, Hanbelîler ve Zahirîler tarafından hadd olarak kabul edilmektedir. Ancak cumhur içki içme haddinin miktarı konusunda ihtilâf ermişlerdir. Bununla beraber içki içme cezasının Hz. Peygamber dönemindeki uygulanma şekli başta olmak üzere sahâbîler dönemindeki farklı uygulamalara konu olması bu cezanın hadd oluşuna ilişkin tartışmaları beraberinde getirmiştir. Erken dönemden itibaren içki içme cezasının hadd değil ta‘zîr türünden bir ceza olduğu görüşü ortaya atılmıştır. Araştırma içki içme cezasının türüne (hadd-ta‘zîr) ilişkin ileri sürülen tartışmalara odaklanmaktadır. Bunun için ilk önce hadd cezalarının genel özelliklerine değinilecektir. Bu çerçevede içki içme cezasının İslâm dinindeki tarihine ilişkin genel bir perspektif sunulacaktır. Burada içki içme cezasıyla ilgili farklı yaklaşımların oluşmasını sağlayan rivâyetler toplu olarak aktarılacaktır. Akabinde içki içme cezasının hadd olarak kabul edenlerin görüşleri ve delilleri fıkhî mezhebler bağlamında ele alınacaktır. Daha sonra içki içme cezasının ta‘zîr türünden bir ceza olarak kabul edenlerin görüşleri delilleriyle beraber zikredilecektir. Son olarak da içki içme cezasına ilişkin farklı görüşler esas alınarak genel bir değerlendirme yapılacaktır.

Abstract The most famous classification of punishments in Islamic law is the trilogy classification based on ḥadd, Retaliation (qıṣâṣ) and taʿzīr. The punishment for drinking (wine) is accepted as ḥadd by Hanafīs, Şāhāfi‘īs, Malikīs, Hanbalīs and Zahirīs. From the early period, it was put forward that the penalty for drinking (wine) was not ḥadd, but a taʿzīr of punishment. The research focuses on the arguments about the type of wine (ḥadd-ta‘zīr) punishment. Here, the narratives (rivâya) that lead to different approaches to wine punishment will be conveyed collectively. Subsequently, the opinions and evidence of those who accept the punishment of wine as ḥadd will be discussed in the context of fiqh sects. Subsequently, the opinions of those who consider the punishment of wine as a ta‘zīr shall be mentioned together with the evidence.
