Aile toplumuzu oluşturan en küçük yapı taşıdır. Toplumların devamı ve gelecek nesillerin yetişmesinde böylesine önemli role sahip olan aile kurumu doğal olarak hukuk sisteminde de ayrı bir alan olarak yer edinmiştir..Aile hukuku, aileye ilişkin konularla ilgilenen, medeni hukukun kapsamı içinde yer alan bir hukuk dalıdır. Aile hukukunun başlıca konuları nişanlanma, evlenmenin koşulları ve hükümleri, boşanmanın koşulları ve sonuçları, mal rejimleri, aile konutu, soybağı, evlat edinme, velayet, çocuğun nafaka hakkı, vesayet, kayyımlık, yasal danışmanlık, yardım nafakasıdır. Kadın hakları ve çocuk hakları, başlı başına ayrı inceleme alanı oluştursa da aile hukukunun da ilgi alanı içindedir. Bu çalışmada , 1959 yılı ve 188 sayılı Irak Aile 1959 yılı 188 sayılı Aile Kanunu’nun , yapılan tüm değişikliklerin ve aile mahkemelerinin çalışmalarının temelini oluşturan basit bir açıklama ile ilgilidir.
The family is the smallest building that forms our society. The family institution, which has such an important role in the continuation of societies and the development of future generations, has naturally also taken place as a separate field in the legal system.Family law is a branch of law that concerns issues related to the family, within the scope of civil law. The main subjects of family law are marriage, the conditions and conditions of marriage, the conditions and consequences of divorce, property regimes, family housing, nursing, childbirth, custody, the right of the child to feed, custody, dismissal, legal advice, assistance. Women’s rights and children’s rights, though alone, are a separate examination area, are also within the area of interest of family law. This study relates to a simple explanation of the 1959 and 188 Iraqi Family Act of 1959 and 188 Family Act of 1959, which forms the basis of all the amendments made and the work of family courts.

The main issues of family law are participation, the terms and conditions of marriage, the terms and consequences of divorce, property regulations, family residency, grandchildren, adoption, custody, the child's right to support the child, guardianship, guardianship, legal advice, and child support. Although women's and children's rights are a separate area of inquiry in themselves, they fall within the content of family law.
