7036 sayılı İş Mahkemeleri Kanununun “görev” başlıklı 5. maddesi, 3 bentten oluşmaktadır. Çalışmamızda da Kanundaki düzenleme doğrultusunda iş mahkemelerinin görevi üç ana başlık altında incelenmiştir. Buna göre öncelikli olarak, “bireysel iş kanunlarına ve Türk Borçlar Kanununa tabi işçiler ile işveren veya işveren vekilleri arasındaki uyuşmazlıklar”, ikinci olarak “idari para cezalarına itiraz ile Sosyal Güvenlik Kurumunun ve Türkiye İş Kurumunun taraf olduğu uyuşmazlıklar” ve üçüncü olarak da “diğer kanunlarda iş mahkemelerinin görevli olduğu uyuşmazlıklar” çerçevesinde iş mahkemelerinin görevi ele alınmıştır. Konu ele alınırken, 7036 sayılı yeni İş Mahkemeleri Kanunu ile 5521 sayılı Kanun arasında kıyaslamalar yapılmış, yenilik getiren düzenlemeler belirlenerek bunların isabetli olup olmadığı değerlendirilmiştir. Ayrıca yeni Kanun’daki eksiklikler de belirlenmeye çalışılarak, olması gereken hukuk bakımından görüşlerimiz açıklanmıştır.
Article 5 of the Law No. 7036 of the Labour Courts, entitled "Mission", consists of 3 paragraphs. In our work, according to the law, the task of the business courts has been examined under three main titles. According to this, in the first place, “the disputes between the workers and the employer or the employer’s advocates under the individual business laws and the Turkish Debt Act”, in the second place, “the disputes that the Social Security Institution and the Turkish Labour Institution are party to withdrawal of administrative penalties” and in the third place, “the disputes in which the business courts are responsible in other laws” have been addressed. When discussing the issue, comparisons were made between the new Law No. 7036 of the Business Courts and the Law No. 5521, and the new regulations were determined and assessed whether they were appropriate. In addition, we are trying to identify the shortcomings in the new law, and we have explained our views in terms of law that should be.
