Bu çalışma temel hak ve hürriyetlerin kullanılmasının durdurulmasını açıklamaktadır. Amaç, temel hak ve hürriyetlerin olağanüstü dönemlerde durdurulmasının sınırsız olmadığını göstermektir. Çalışmamızda literatür taraması sonucu tarihsel karşılaştırma yöntemi de kullanılarak tarama/değerlendirme metodu kullanılmıştır. Literatür taraması sonucu ise daha önce bizim çalışmamızda yer alan kavramları bir araya getiren hiçbir çalışma yapılmadığı ve böyle bir çalışma yapılması gerekliliği görülmüştür. Öncelikle çalışmamızın temel noktalarını oluşturan Anayasa, insan hakları ve temel haklar kavramları, tarihsel süreçlerini de içine alacak şekilde tanımlanmaktadır. Daha sonrasında temel hakların kullanılmasının sınırlandırılması ve durdurulması kavramları arasında ne gibi bir fark olduğu ortaya konulmuştur. Durdurulma kavramının Anayasal zeminini açıklamak amacıyla 1982 Anayasası ve daha önceki Anayasal metinlerdeki durumu ele alınmaktadır. Daha sonra Anayasa Mahkemesinin Temel Hakların Durdurulması konusunda vermiş olduğu kararları incelenmektedir.
This study explains the suspension of the use of fundamental rights and freedoms. The aim is to show that the stop of fundamental rights and freedoms in extraordinary periods is not unlimited. In our study we used the historical comparison method of scanning/evaluation of the results of literature scanning. As a result of the scan of literature, we have seen that no work has been done that combines the concepts included in our work before and that such work is needed. First of all, the Constitution, the concepts of human rights and fundamental rights, which constitute the fundamental points of our work, are defined in such a way as to include their historical processes. It was later revealed what the difference was between the concepts of limitation and discontinuation of the use of fundamental rights. In order to explain the Constitutional foundation of the concept of suspension, the situation in the 1982 Constitution and previous Constitutional texts is discussed. The decision of the Constitutional Court on the suspension of fundamental rights is subsequently examined.
