20. yüzyılda mülteciler dünya için ciddi bir sorun olmuş ve bunun temel nedenini yaşanan silahlı çatışmalar oluşturmuştur. Bu durum mülteci statüsü kazanarak Mülteci Hukuku kapsamında korunan kişilerin yanı sıra mülteci statüsü elde edemeyen bir insan topluluğunu da ortaya çıkarmış ve bu kişilerin nasıl korunabileceği sorusu gündeme gelmiştir. Silahlı bir çatışmanın ortasında kalan kişilerin korunmasında başvurulabilecek kaynaklardan biri İnsancıl Hukuktur. Ancak insancıl hukukun bu kişileri etkin bir şekilde koruyup koruyamayacağı tartışmalıdır. Zira insancıl hukuk mültecileri ancak korunan kişi kategorilerinden biri olması durumunda koruma altına almaktadır. Bu sınırlı bir koruma olsa da insancıl hukuk mülteci statüsünün korunmasında aranan zulüm kavramının yorumlanmasında da başvurulabilecek bir kaynaktır.
In the 20th century, refugees have been a serious problem for the world and the main reason for this has been the armed conflicts. This situation caused the emergence of a group of people who could not obtain refugee status as well as those who were protected under the Refugee Law by gaining refugee status, and the question of how the former could be protected came to the fore. Humanitarian Law is one of the resources that can be utilized to protect people caught in the middle of an armed conflict. However, it is controversial whether humanitarian law can effectively protect these people. Because humanitarian law protects refugees only if they are one of the protected person categories. Although this is a limited protection, humanitarian law is also a resource that can be used to interpret the concept of persecution sought in the protection of refugee status.
