Abstract:

The subject of the study is to compare the Law-i Family Decree, which is the product of the "new drinking and legislation" period, with the Malaysian Islamic Family Law (Federal Region) Act 1984 as a whole. The study and the dogmatic structure of Islamic law and the intrinsic characteristics of the laws referred to have been observed. The fact that such a comparison has not been done before makes this work relatively original. In the work, both the provisions of the law and the implementation of the law were given place. The findings can be summarized as follows: the two countries are concerned with different reasons, as well as common reasons and findings for codifying family law. IFLA in 1984 saw a better response to HAK in the Nazaran society. Both laws have strictly and in detail regulated the mechanisms of the state to control the family law, although it is not a compulsory provision in this direction in Islamic law. The two laws were based on the opinions of the four Sunnites during the time mentioned. His legal experience and the horizon he opened appears to be beneficial to IFLA 1984. The norm-ar that regulates family relations must be clearly regulated under a single roof, in a complex collective, modern style, based on four Sunnis, taking into account the socio-economic, cultural changes that occur in society.
