Miladi 14. asrın kelâm ve fıkıh sahalarında Hanefî mezhebinin yılmaz bir savunucusu olan Sadrüşşerîa, aşırı uçlardan uzak düşüncesiyle akla muhkem bir otorite sunar. O, kelamcıların aklın mutlak hâkim olup olmaması yönüyle tartıştığı hüsün-kubuh/iyilik-kötülük meselesinde ve fakîhlerin şer’î hitapta aklın mutlak hâkim olup olmaması yönüyle tartıştığı mahkûmün aleyh/mükellef meselesinde orta yol düşüncesini tesis ederek aklın Şeriat’e bağlı aktif bir otorite olduğunu savunur. Mütekellim ve fakîh kimliğiyle nakle değil, eleştiriye dayalı bir bakış açısına sahip olan Sadrüşşerîa, mensup olduğu matürîdî mezhebinin hüsün-kubuh’ün belirlenmesinde Şâri’in nassını esas alan Eş’ârîyye’den ve aklın müstakil hakimiyetini esas alan Mu’tezîle’den farklı bir yapıya yani bu iki mezhebin ortasında yer alan mutavassıt bir düşünce sistemine sahip olduğunu aklî delillerle ispat etmeye çalışır. Bu makalemiz, kelâmın ve hukukun kesiştiği özel bölge olan aklın otoritesine ve aklın sahip olduğu sınırlara dair Hanefî hukukçu Sadrüşşerîa’nın eleştirel düşüncesini ve bu düşüncesiyle ilgili delillendirmelerini ortaya koymayı amaçlamaktadır.
In the 14th century, Miladi is a prominent advocate of the Hanefî mosque in the fields of words and fights, and Sadrüşşerîa offers a reasonable authority with its thinking far from the extreme ends. It is not a translation with its identity, but a criticism-based viewpoint, the Sadrüşşerîa, who is a member of the maturied mosque in the determination of the hüsün-kubuh of the Shari's nass, and a different structure from the Mu'tezîle, which is based on the intellectual domination, that is, the two mosques in the middle of the two mosques, trying to prove with intellectual evidence that it has a mutual thought system. This article aims to reveal the critical thought of Hanefî lawyer Sadrüşşerîa about the authority of the mind, which is the particular area where the word and law intersect, and the limits that the mind possesses, and their evidence about this thought.
