Bütçe hakkının yasama organına ait olması, bütçenin hazırlanma, onaylanma, yürürlüğe girme ve denetim sürecini kapsamakta ve harcamalar için ödenek tahsis edildikten sonra bütçenin yasama organının onayladığı şekliyle uygulanmasını gerektirmektedir. Bu açıdan bakıldığında, yürütmenin ödenek aktarma işlemleri yoluyla bütçede yıl içinde değişiklik yapması yürütmeye bütçe uygulamalarında esneklik sağlamakla birlikte, bu işlemlerin sınırları tam çizilmeden sıklıkla başvurulan bir mekanizma haline dönüşmesi, ödeneklerin veriliş amacı dışında kullanılmasına ve yasamanın bütçe hakkının zedelenmesine yol açabilmektedir. Bu durum ise yürütmeyi onaylanan bütçe dışında kaynak tahsisi tercihlerine yöneltmekte ve bütçenin takibini zorlaştırmaktadır. Ödenek aktarmalarının bütçe hakkı üzerinde neden olduğu olumsuz etkilerin giderilmesi için yürütmenin ödenek aktarmaları konusunda bir takım sınırlamalara tabi tutulması gerekmektedir. Bu çalışmada, ödenek aktarma işlemlerinin bütçe hakkı çerçevesinde değerlendirilmesi ve yürütmenin ödenek aktarmaları konusunda kullanabileceği yetkinin sınırlarının belirlenmesi amaçlanmıştır.
The right to the budget requires that the legislative body shall cover the process of preparation, approval, entry into force and audit of the budget and that the budget shall be applied in the manner approved by the legislative body after the payment for the expenditure is allocated. In this regard, while providing flexibility in budget applications to implement changes in the budget over the year by means of payment transfers, the limitations of these transactions can be transformed into a mechanism that is often applied without a complete drawing, the use of payments outside the granting purpose and the degradation of the budget rights of the legislation. This situation, in addition to the approved budget, turns to the resource allocation preferences and makes it difficult to follow the budget. To eliminate the negative effects of payment transfers on budget rights, the execution must be subject to a set of limitations on payment transfers. This study aims to evaluate payment transactions within the framework of budget law and to determine the limits of competence that the execution can use in payment transactions.
The fact that the power of the purse is attributed to the legislative body includes the processes of preparation, approval, execution, and audit of the budget and requires the implementation of the budget as approved by the legislative body after the appropriation for the expenditures is allocated. From this perspective, while the changes made by the executive body in the budget throughout the year via budget virements provide flexibility to the executive body in the budget implementation, if these transactions turn into a frequently used mechanism without clearly set limits, this may lead to the misuse of the appropriations and weaken the parliament’s power of the purse. This directs the executive to resource allocation preferences rather than approved budget and makes the surveillance over the budget difficult. In order to eliminate the negative effects caused by budget virements on the power of the purse, the executive should be subject to some restrictions on budget virements. This study aims to evaluate budget virement mechanism within the framework of the power of the purse and to determine the limits of the authority that the executive can exercise for budget virements.
