Mazbut vakıflara ait taşınmazların kiraya verilmesinde Devlet İhale Kanunu uygulanmaktadır. Bu Kanuna göre hazırlanan tip kira sözleşmesinde kira süresinin geçmesi bir sona erme sebebi olarak gösterilmiştir. Mazbut vakıfların konut ve çatılı işyeri niteliğindeki taşınmazlarının da kira sözleşmesinin konusu olabileceği dikkate alındığında bu sebebin söz konusu taşınmazları konu edinen kira sözleşmelerini sona erdirdiği kabul edilmemelidir. Vakıflar Kanununa eklenen yeni düzenlemede, üç aylık kira bedelinin ödenmemesi sözleşmeyi sona erdiren ve taşınmazın tahliyesini gerektiren bir sebep olarak belirtilmiştir. Mazbut vakıflara ait taşınmazların onarım veya inşa karşılığı kiralanmalarını konu edinen kira sözleşmelerinin bu sebeple sona ermesi halinde tahsil edilemeyen kira alacağı ve tahliye masrafları da alınan teminattan mahsup edilir.
For the purposes of the rental of non-mobile funds, the state tender law is applied. This type of rental agreement prepared under this law is indicated as a reason for the expiry of the rental period. Considering that the non-migration of the Mazbut foundations in the nature of housing and roof workplace may also be the subject of the rental contract, it should not be accepted that the reason for the non-migration concerned is the termination of the rental contracts. In the new regulation added to the Foundation Act, the non-payment of the three-month rental price is indicated as a reason that terminates the contract and requires the dismissal of the non-mobile. In the event of the expiration of the rental contracts concerning the rental or repair of non-mobile funds of the Mazbut foundations, the rental will not be charged and the discharge costs will also be deposited from the guarantee obtained.
