Abstract:

The Istanbul Convention, which is the original name of the "Convention of the European Council on the Prevention and Combating Violence Against Women and Violence in the Family", was signed on 11.05.2011 and was the first country to approve the Convention on 12.03.2012. In the past months, with a Presidential Decree published in the Official Gazette on 20.03.2021, our country has dismissed the Istanbul Convention. However, the place and importance of the Convention for our country is quite large. For both the will to be the first country to approve the Convention has demonstrated our sensitivity to violence against women, and shortly after the Convention has been approved, again, inspired by the provisions of the Convention, the Law No. 6284 on the Protection of the Family and the Prevention of Violence Against Women has been adopted. Law No. 6284 has an important place in the striking struggle against women in terms of scope and number of articles. If we have terminated the Istanbul Convention and therefore take advantage of Article 90 of the Constitution, considering that the Convention is not permissible to be applied in domestic law, it can be said that the importance of Law No. 6284 increases further. In our work in this context, by briefly mentioning the Istanbul Convention, we draw attention to the similarities, differences between the Convention and Law No. 6284 and, in this case, some deficiencies in the Law.
