Abstract:

The subject of this article is the protection of personal data within the context of human rights and fundamental rights and freedoms. For this purpose, the scope of the right to protection of personal data has been stated by first explaining the notion of personal data and both the international and domestic regulations related to the subject. After that, the boundaries of human rights and fundamental rights and freedoms have been explained, and place of right to protection of personal data especially in right of privacy and other fundamental rights have been determined. Thus, the issue of whether the right to protection of personal data is an independent right have been tried to be resolved. In this context, Constitutional Court’s and European Court of Human Rights’ points on view on the issue have been evaluated by explaining their decisions about the issue. As a result, the place of the right to protection of personal data especially in the right of privacy and the other fundamental rights and freedoms, has been tried to be determined in the light of European Court of Human Rights and Constitutional Court decisions
