Bu çalışmada İslam Aile Hukuku’nda evlilik öncesi ve evlilik sonrası uygulamalarda kadın ve erkekte eşitlik mensubu ve istisnaları Kur’an-ı Kerim, Sünnet ve çeşitli İslam bilginlerinin görüşleri ışığında irdelenmeye çalışılmıştır. Eşitlik kavramı hakkında İslam Aile Hukukunda kendine özgü ifadeler yer aldığı görülmektedir. İslam Aile Hukuku eşitlik kavramından ziyade adalet kavramı üzerinde durmaktadır. İslam Aile Hukuku temel haklarda bütün insanları eşit görmüş fakat yaratılış ile kabiliyetlerdeki farklılıkların göz ardı edilmemesi hususuna dikkat çekmiştir. Bazı durumlarda kişiye hakkını teslimde eşitliği bozan durumların ortaya çıktığı söylenebilmektedir. Özetle, değişen yaşam koşulları, Kur’an ayetlerinin ve hadislerin farklı bakış açılarıyla yorumlanışı söz konusu eşitlilik mefhumu için farklı görüşlere de neden olduğu açıktır. Bu durumlar din ayrılığı, sıhhat, fiziki, cinsiyet, psikolojik farklılıklar vb. gibi unsurlardan kaynaklandığı görülmektedir. Söz konusu belirtilen unsurların zahirde eşitliği bazen bozduğu görülse de İslam Aile Hukuku’nda adaletsizliği önleyen ve aksine adaleti sağlayan unsurlar olarak belirtilmektedir. İslam Aile Hukuku’nda “her eşitsizlik, adaletsizlik değildir” kavramının vurgulandığı söylenebilir. İslam Aile Hukukunda adalet kavramının eşitlik kavramından daha ön planda tutulduğu söylenebilir.
In this study in the Islamic Family Law, in the practice before and after marriage, women and men are equal members and exceptions in the light of the opinions of the Qur’an, the Qur’an, the Sunnah and the various Islamic scientists. The concept of equality appears to have its own expressions in Islamic Family Law. The Islamic Family Law stands on the concept of equality rather than on the concept of justice. The Islamic Family Law has seen all people equal in fundamental rights, but has not taken note that the differences in creation and abilities are not neglected. In some cases, it can be said that the rights of the person in the submission of equality are disrupted. In short, it is clear that the changing conditions of life, the interpretation of the Qur’an verses and hadits from different perspectives also lead to different opinions for the subject equality. These situations include religion separation, health, physical, gender, psychological differences, etc. It appears to be derived from elements. Though the elements mentioned above sometimes appear to be distorted by equality in the Zahar, they are referred to as elements that prevent injustice in the Islamic Family Law and, on the contrary, provide justice. In the Islamic Family Law, it can be said that the concept of "all inequality is not injustice" is emphasized. In the Islamic Family Law, the concept of justice is more advanced than the concept of equality.
