Sosyal devlet ilkesinin yerleşmesi ve devlet karşısında vatandaşlık haklarının gelişmesine muvazi olarak devletin vatandaşlar karşısında sorumluluk alanları genişlemiştir. İdarenin kusurlu sorumluluk hallerinin yanında, kusursuz olsa dahi sorumlu tutulduğu haller mevcuttur. Kamu külfetleri karşısında eşitliğin bozulmasından dolayı sorumluluk bu haller arasındadır. Lakin şunu vurgulamak gerekir ki, kamu külfetleri karşısında eşitlik ilkesi ibaresi anayasanın muayyen bir maddesinde açıkça belirtilmez. Böylece bu konunun literatürdeki yazımı içtihatlar üzerindendir. Başta Danıştay olmak üzere temyiz mercilerinin bazı kararlarından yola çıkılarak ve Türk idare hukukuna model teşkil eden Fransız hukuk sistemindeki uygulamalar dikkate alınarak Kamu külfetleri karşısında eşitlik ilkesinin tanımı, şartları, özellikleri ve türleri çerçevesinde bir alan yazın geliştirilmiştir. İşte bu çalışmada Danıştay içtihatları bağlamında geliştirilmiş olan kamu külfetleri karşısında eşitlik prensibin ana hatları ele alınmış, bu ilkenin tanımı, hukuki dayanakları, şartları ve özellikleri kararlar eşliğinde sunulmaya çalışılmıştır. Çalışma nitel araştırma tekniklerinden betimsel yöntem kullanılmıştır. Bu yönteme uygun olarak elde edilen veriler, konunun perspektifi bağlamında işlenmiş, analiz edilmiş ve tanımlanmıştır.
The establishment of the social state principle and the development of the rights of citizenship against the state have expanded the areas of responsibility against the citizens of the state. In addition to the defective accountability of the administration, it is perfectly held responsible. The responsibility for the disruption of equality in the face of public parties is among these situations. But it must be emphasized that the principle of equality in the face of public parties is not clearly stated in a review article of the Constitution. This is the subject of the writing in the literature. Based on some decisions of the appeal courts, including the Council, and taking into account the practices in the French legal system that forms the model of Turkish administrative law, a field in the framework of the definition, conditions, characteristics and types of the principle of equality against public parties has been developed in the summer. In this study, the main lines of the equality principle were addressed in the context of the public aspects developed by the Council, the definition of this principle, the legal basis, the conditions and the characteristics of this principle were tried to be presented in conjunction with decisions. The research method is used by the research technique. The data obtained according to this method is processed, analyzed and identified in the perspective context of the subject.
