İşletmelerde, işçi haklarının korunması gereği, sosyal adalet hükümleri doğrultusunda herkesçe kabul edilmektedir. Ancak, işçinin işinin korunması için de, işletmenin devamlılığının korunması zorunludur. 4857 sayılı yasa, işletmelerde sağlık açısından meydana gelebilecek açıklıkların süregelmesini önlemek için, birtakım önlemler getirmiş, devamsızlığın sürmesi durumunda işverenin, iş sözleşmesini tek taraflı olarak feshetmesi, ancak bu feshin, işçinin maddi olanaklarını kısıtlamaması için çeşitli hükümler getirmiştir. Bu incelemede, İş Kanunu 25/I maddesinde anılan sağlık nedeniyle fesih düzenlemesi ve bu alandaki uygulamalar incelenmeye çalışılmıştır.
