Çalışmanın konusunu, Türk Ceza Kanunu’nun 118. maddesinde düzenlenmiş olan “sendikal hakların kullanılmasının engellenmesi suçu” oluşturmaktadır. Bugüne kadar bu konuya ilişkin ayrıntılı bir çalışma yapılmamış olması ve konunun çeşitli sorunları içermesi nedeniyle söz konusu suçu inceleme gereği duyduk. Çalışmada; öncelikle sendikal hak kavramını ve Türkiye’deki durumu, daha sonra suçun yapısal unsurlarını, suça etki eden nedenleri ve yaptırım konularını inceledik. Sonuç kısmında ise, sendikal hakların kullanılmasının engellemesi suçuna ilişkin ulaştığımız kanaat ve önerileri ifade ettik.
The subject of the study is the "crime of blocking the use of trade union rights" which is regulated in Article 118 of the Turkish Criminal Code. We have heard that there has not been a detailed study on this subject until now and that the subject contains various issues, and that the criminal offence has to be investigated. In the study, we first examined the concept of trade union rights and the situation in Turkey, then the structural elements of crime, the causes that influenced the crime and the subjects of sanctions. In the conclusion, we expressed the claims and suggestions we got about the crime of the prohibition of the use of trade union rights.
