Manevî Hakların Eser Sahibinin Ölümünden Sonra Kullanılması: FSEK Madde 19 Üzerine Bir Tedkik

Eser üzerinde onu meydana getiren kimseye tanınmış haklara telif hakları denir. Telif hakları, sahibine manevî ve malî yetkiler bahşeder. Manevî haklar eser sahibinin kişiliğiyle ilgili, malî haklar ise ekonomik menfaatleriyle ilgili yetkilerden oluşur. Malî haklar hak sahibince, başka kişilere devredilmek veya lisans tanınmak suretiyle kullanılabilir. Ancak, eser sahibi manevî hakları ya bizzat kullanır veya yetkilendirdiği başka bir kişi vasıtasıyla kullanır. Manevî hakların para karşılığı değerlendirilmesi mümkün değildir; yani eser sahibi bedeli karşılığında bu hakları bir başka kişiye devredemez. Malî haklar eser sahibi öldüğü zaman mirasçılara intikal eder. Ancak Türk telif hukukuna göre manevî hakların miras yoluyla intikali mümkün değildir. Bununla beraber manevî haklardan bazıları, eser sahibi öldükten sonra, kanunun öngördüğü belirli bir süreyle eser sahibinin bazı yakınları tarafından kullanılabilir. Manevî hakların eser sahibinin ölümünden sonra kimler tarafından hangi süre zarfında kullanılabileceği FSEK’in 19. maddesinde düzenlenmiştir. Bu makalede, eser üzerindeki malî hakların eser sahibinin ölümünden sonra kullanılmasını düzenleyen mezkûr Kanunun 19. maddesinin analizi yapılmaktadır.

The use of intellectual rights after the death of the owner: A warning on Article 19 of the FSEK

Whoever has the right to do it, has the right to do it. The copyright gives the owner spiritual and financial powers. The intellectual rights relate to the personality of the property owner, and the property rights consist of powers relating to the economic interests. The property rights may be used by the right to be transferred to other persons or by recognition of the license. However, the copyright owner shall either exercise his intellectual rights personally or through another person authorized by him. The intellectual rights cannot be assessed in exchange for money; that is, the property owner cannot transfer these rights to another person in exchange for the price. When the owner of the property is dead, the inquisition shall be made to the inheritors. However, according to Turkish copyright law, it is not possible to revenge spiritual rights through heritage. However, some of the spiritual rights may be used by some of the relatives of the owner, after the death of the owner, for a certain period provided for by the law. Article 19 of the FSEK states in which period the intellectual rights may be used by who after the death of the copyright holder. In this article, the analysis of Article 19 of the Mescouran Law, which regulates the use of the property rights on the work after the death of the owner of the work.

Abstract:

Copyright is a right granted to anyone who creates an original work. Copyright grants moral and economic benefit and authority to the author of an artistic and literary work. Economic rights provide economic benefits the author, whereas moral rights consist of powers related to his personality. Economic rights can be used by the owner himself, by transferring them to other persons, or by granting a license. However, the author uses the moral rights either through the powers that he has granted to another person or by himself. It is not possible to evaluate the moral rights for money, that is, the owner of the work cannot transfer these rights to another person for the price. When the owner of the work dies, economic rights are transferred to the heirs. It is not possible to transfer moral rights on the copyrighted work through inheritance according to Turkish Copyright Law. However, after the author dies, some of the moral rights can be used by some relatives of the author for a certain period prescribed by the law. It is regulated in the 19th article of Turkish Copyright Code (TCC) under Turkish Copyright Law. This essay analyses the article 19 of the TCC that regulates the use of economic rights on the work after the death of the author.
