Suç ve suçlulukla mücadele bakımından, yetkili makamların suçlardan ve suçlulardan haberdar olması gerekir. Bu nedenle sağlık mesleği mensuplarına görevlerini yaptıkları sırada suç işlendiğine yönelik bir belirtiyle karşılaşmaları durumunda yetkili makamlara bildirimde bulunma yükümlülüğü getirilmiştir. Sağlık mesleği mensuplarının bu yükümlülüğü ihlal etmeleri, yani suçu bildirmemeleri 5237 sayılı Türk Ceza Kanunu (TCK)’nun 280’inci maddesinde suç olarak düzenlenmiştir. Çalışmamızda TCK’nın 280’inci maddesinde düzenlenen bu suç incelenecektir. TCK’nın 280’inci maddesi iki fıkradan oluşmaktadır. İlk fıkrada suçun kanuni unsurları ve karşılığında öngörülen yaptırım düzenlenmiştir. İkinci fıkrada ise “sağlık mesleği mensubu” ibaresinden ne anlaşılması gerektiği belirtilmiştir. Sağlık mesleği mensubu görevini yaptığı sırada bir suçun işlendiği yönünde bir belirti ile karşılaşmasına rağmen, durumu yetkili makamlara bildirmez veya bu hususta gecikme gösterirse bir yıla kadar hapis cezası ile cezalandırılır. Bu suçun faili olan kişilerin muhakkak “sağlık mesleği mensubu” sıfatını haiz olması gerekmektedir. Sağlık mesleği mensubu deyiminden tabip, diş tabibi, eczacı, ebe, hemşire ve sağlık hizmeti veren diğer kişiler anlaşılır.
In order to combat crime and crime, the competent authorities must be aware of the crimes and criminals. Therefore, the health professionals have the obligation to inform the competent authorities if they encounter a sign of the crime when they perform their duties. The violation of this obligation by members of the health care profession, i.e. not reporting the crime, is defined as a crime in Article 280 of the Turkish Criminal Code (TCK) No. 5237. This crime will be investigated in Article 280 of the TCK. The article 280 of the TCK consists of two jokes. In the first paragraph, the legal elements of the crime and the sanctions provided for in return were arranged. In the second chapter, it is stated what to be understood as a "health professional member". Although a health professional is faced with a sign of the fact that a crime has been committed during his office, he will not report the situation to the competent authorities or, if there is a delay in this matter, he will be punished with a prison sentence of up to one year. The person who commits this crime must be the "member of the healthcare profession" status. The term members of the health care profession understands the doctors, dentists, pharmacists, parents, nurses and other persons providing health care.
