Hekimin, meslek etik kuralları ve insani ilkeler çerçevesinde hem hastasına hem devlete karşı yerine getirmekle bağlı olduğu birtakım yükümlülükleri bulunmaktadır. Bunlardan biri olan sır saklama yükümlülüğü hastanın özel yaşam alanına yönelik, hem bedensel hem de manevi bir koruma sağlamaktadır. Hasta teşhis ve tedavi sürecinde hekim ile bazı özel bilgilerini paylaşabilir. Kişilerin sağlık bilgileri kişisel veri sayılır ve tedavi süresi boyunca edinilen bilgiler gizli kalmak zorundadır. Hekim, hastasının gizli kalmasında menfaati olan her türlü bilgiyi sır saklama yükümlülüğü kapsamında saklamakla yükümlüdür. Tıbbi incelemeler neticesinde elde edilen kişisel bilgiler de hekimin sır saklama yükümlülüğü kapsamındadır. Hastaya ilişkin tüm bu bilgilerin başkalarına aktarılması ancak hastanın rızasıyla mümkündür. Bu yükümlülüğe aykırı davranılması halinde ise kişisel verileri hukuka aykırı olarak verme veya ele geçirme suçu (TCK m. 136) oluşur. Hekimler, görevini yaptığı sırada bir suçun işlendiği yönünde bir belirti ile karşılaşmasına rağmen durumu yetkili makamlara bildirmez veya bu hususta gecikme gösterirse TCK m. 280’de düzenlenen sağlık mesleği mensubunun suçu bildirmemesi suçu oluşur. Hekimlerin sır saklama yükümlülüğü ile suçu bildirme yükümlülüğü arasında çelişki olduğu aşikârdır. Bu gibi durumlarda kanun koyucu bildirim yükümlülüğünü daha üstün tutmuş ve bildirim yükümlülüğü sebebiyle sır saklama yükümlülüğünün ihlal edilebileceğini kabul etmiştir. Suç teşkil eden bir fiilin işlendiğini öğrenen bireyin, bununla ilgili olarak yetkili makamlara bildirimde bulunma hakkı vardır. Suçu bildirmeme suçu herkes (TCK m. 278), kamu görevlileri (m. 279), sağlık mesleği mensupları (m. 280) tarafından işlenmesine göre üç ayrı maddede düzenlenmiş olmasına rağmen aynı hukuki değeri korumaktadır. Nitekim söz konusu maddelerin gerekçeleri de birbirini doğrular niteliktedir. Hekimlerin sır saklama yükümlülüğüne dayanarak hastayı ilgilendiren bir durum ile ilgili tanıklıktan çekinebilme hakkı da bulunmaktadır (CMK m. 46/1-b).

The doctors, although they encounter a sign of the fact that a crime has been committed during their duty, do not report the situation to the competent authorities or if there is a delay in this matter, the crime is that the health professional member organized in TCK m. It is clear that there is a contradiction between the doctors’ duty to hide the secret and the duty to report the crime. In such cases, the lawmaker has held the obligation to notify more and has agreed that the obligation to keep the secret due to the obligation to notify may be violated. The person who knows that a crime is committed has the right to inform the competent authorities about it. The criminal offence has the same legal value, although it is regulated in three separate articles according to the processing by the public officials (m. 278), the health professionals (m. 280) and the same legal value. In fact, the reasons for the subjects are mutually true. The doctors are also entitled to fear the identity of a condition that concerns the patient on the basis of their obligation to keep the secret (CMK 46/1-b).
