Bu çalışma ile sendikal tazminat kavramı 7036 sayılı İş Mahkemeleri Kanunu kapsamında incelenmiştir. Sendikal tazminat özü itibariyle sendikal hak ve özgürlüklerin kullanılmasının engellenmesi için caydırıcı bir unsur olarak düzenlenmiştir. Sendikal tazminatın etki alanı oldukça geniş olmakla birlikte 7036 sayılı yasa çerçevesinde sendikal tazminat talebi dava şartı arabuluculuk kapsamına alınmıştır. Bu çalışma ile sendikal tazminat olgusu aşama aşama incelenmiştir. Buna göre sendikal hak ve özgürlükleri iş ilişkisi kurulmadan önce, iş ilişkisi devam ederken veya iş sözleşmeleri sona ererken engellenmiş olanların durumları ayrı ayrı irdelenmiştir. Bu bağlamda sendikal tazminat talebinin, dava şartı arabuluculuk müessesesi kapsamında kimler tarafından talep edilebileceği, tarafların kimler olabileceği, görüşmeler sırasında hangi hususların tartışılabileceği, anlaşma ve anlaşmama hususları ayrıntılı olarak irdelenmiştir.
This study examined the concept of trade union compensation within the framework of Law No. 7036 on Labour Courts. According to the essence of trade union compensation, it is arranged as a repressive element to prevent the use of trade union rights and freedoms. The area of effect of the trade union compensation is quite wide, but in the framework of law No. 7036 the trade union compensation request has been taken into the scope of the proceedings. With this study, the facts of trade union compensation have been examined stage-by-step. According to this, trade union rights and freedoms have been separated by the situations of those who have been blocked before the establishment of a business relationship, while the business relationship continues or when the contracts end. In this context, the trade union compensation request is detailed, who can be requested within the framework of the case-condition mediation agency, who the parties can be, which matters can be discussed during negotiations, the matters of agreement and agreement.
With this study, the concept of union compensation was examined within the scope of the Labor Courts Law numbered 7036. Union compensation is essentially designed as a deterrent to prevent the use of union rights and freedoms. Although the effect area of union compensation is quite wide, within the framework of Law No. 7036, the demand for union compensation is included in the scope of mediation as a condition of bringing a lawsuit. With this study, the phenomenon of union compensation is examined step by step. Accordingly, the situation of those who have been prevented from the union rights and freedoms while the trade union rights and freedoms were established before the labor relations was established, while the labor relation was continuing or when the labor contract was terminated, were examined separately. In this context, the question of by whom the union compensation can be requested, who may be the parties, what issues can be discussed during negotiations, and the issues of agreement and non-agreement are discussed in detail, within the scope of the mediation institution.
