Çalışmamızın konusu, Türk ve İngiliz hukukunda iş sözleşmesinin sona ermesidir. İşçinin veya işverenin iş sözleşmesini sonlandırmasının, Türk ve İngiliz Hukukunda ne şekilde ele alındığına değinilecektir. İngiliz hukukundaki Employment Rights Act 1996 ve 4857 sayılı İş Kanunundaki düzenlemeler dikkate alınacak, mevzuatta yer alan maddelerin karşılaştırılmasına yer verilerek tartışılacaktır. Çalışmamızda inceleneceği üzere; Türk ve İngiliz Hukuku bakımından, bir iş sözleşmesi iki türlü sona erdirilebilir. Bunlardan biri, genel sebeplerle sona erme, diğeri ise fesih nedeniyle sona ermedir. Ancak her iki hukuk düzeninde benzerlikler olduğu kadar, farklılıklar da mevcuttur. Çalışmamız süresince; Türk ve İngiliz Hukuku bakımından bir iş sözleşmesinin sona ermesine ilişkin olan düzenlemelere ve iki hukuk düzeni arasındaki farklara değinilecektir.
The subject of our work is the end of the business contract in the Turkish and British law. The termination of the employee or employer’s employment contract will be indicated in the way it is addressed in the Turkish and British law. The provisions of Employment Rights Act 1996 and Employment Rights Act No. 4857 in the British law will be taken into account and discussed by comparing the articles contained in the legislation. In terms of Turkish and British law, a business contract can be terminated in two ways. One of them ends for general reasons, and the other ends for dissolution. However, as much as similarities exist in both legal systems, there are differences. During our study, we will refer to the arrangements relating to the termination of a business contract in terms of Turkish and British law and the differences between the two legal arrangements.
