Abstract:

One of the most effective instrument for judicial review provision of the administration is nullity suit. Nullity suit is a kind of administrative suit that provide the removal of unlawful administrative action from the date of decision. Effectiveness of nullity suits provide with stay of execution. Due to this decision, the execution will be stayed throughout the period the decree made for revocation of a process. Many legal changes were made about stay of execution since being introduced to the present day. These changes have made the stay of execution complicated. In this article, be analyzed the legal changes made until today in stay of execution and the causes and results of these changes will be examined. While reviewing and evaluating, it will be used parliamentary minutes about modification proposals; if it is prosecuted suits against modifications at Supreme Court, judicial decisions taken at the result of these suits; decisions of Counsil of State related with the issue
