İnsanların toplumsal ve kültürel yapısını dinamize etmede büyük paya sahip olan vakıf müessesesinin meşruiyeti ve hukuki çerçevesi İslam hukukçuları tarafından ortaya konulmaya çalışılmıştır. İslam hukukçuları, toplum maslahatının hedeflendiği böylesi bir müessesenin hükümlerini belirlerken sürecin daha pratik ilerlemesini ve ortaya koyacakları hükümlerin kendi fıkıh teorilerine mutabık kalmasını ön planda tutmuşlardır. Bu bağlamda vakıf hukukunun hükümleri, mezhepler arası ve mezhep içi tartışmalarla ortaya konulmaya çalışılmıştır. Çalışma Hanefi mezhebinde şâyi‘ (paylı) malın vakfedilmesi konusunu ele almakta ve hükümlerin arka planda oluşumuna ışık tutmaya çalışmaktadır.
The legitimacy and legal framework of the foundation, which has a great role in dynamizing the social and cultural structure of people, has been sought to be revealed by Islamic lawyers. The Islamic lawyers have given the priority to the more practical progress of the process while determining the provisions of such an institution in which the social masters are targeted and that the provisions they will reveal are in accordance with their own fictional theories. In this context, the provisions of the foundation law were attempted to be revealed by interdisciplinary and interdisciplinary discussions. The work of Hanefi in the mosquito deals with the subject of the foundation of the (shared) property and tries to keep light on the formation of the rulings in the background.
