Abstract:

Kefalet türleri şunlardır: 1) Âdi kefalet, 2) Müteselsil kefalet, 3) Birlikte kefalet, 4) Kefile kefalet, 5) Rücua kefalet, 6) Açığa kefalet. Bu makalede (tebliğde), söz konusu kefalet türlerinin her birine ilişkin olarak, özellikle 6098 sayılı Türk Borçlar Kanunu’nda, mülga 818 sayılı Borçlar Kanunu’na göre yapılmış olan aynı veya farklı düzenlemeler hakkında açıklamalarda bulunulmuştur. Bu konularda söz konusu olan bazı hukukî problemler ve bunların çözümlerine ilişkin olarak, önce doktrinde ileri sürülen bazı görüşler belirtilmiş ve daha sonra kişisel değerlendirmeler yapılmış ve “Sonuç” bölümünde de, varılan sonuçlar, maddeler hâlinde özetlenmiştir.
