Hürriyetçi parlamenter rejimle yönetilen demokratik toplumlarda, ifade hürriyeti ve basın-yayın hürriyeti ile kişilik hakkı hukuken düzenlenen ve korunan temel hak ve hürriyetlerdir. İdeal toplum düzeninde vatandaşlar, hak ve hürriyetleri ile ödev ve sorumluluklarını bilen ve bunları başkalarına zarar vermeyecek şekilde kendilerinin ve toplumun refahı için kullanan kimselerdir. Basın-yayın hürriyeti ise haber (olay), bilgi, fikir, düşünce ve kanaatleri çeşitli vasıtalar kullanarak kişilere ve topluma aktarabilme yolu, ifade hürriyetinin kullanılma biçimidir. Kitle iletişim araçları (basın-yayın organları) toplum adına, toplum için haber verme, kamuoyu oluşturma, eleştirme, yorumlama ve kamuya mâl olmuş kişileri ve bütçeyi denetleme gibi önemli görevler icra ederler. İfade hürriyeti ve kitle iletişim hürriyeti dahi hiçbir temel hak ve hürriyet, demokrasinin gereği olarak, sınırsız kabul edilemez. İfade hürriyeti ve kitle iletişim hürriyeti (haber veya fikir verme hakkı dâhil) kişilik hakkı ve kişisel menfaatlerle çatışabilmektedir. Bu çalışmada, toplumsal sorumluluk teorisi bağlamında haber, haber değeri ile haber verme hakkı-kişilik hakkı çatışmasında haberin hukuka uygunluk unsurları incelenmiştir.
In democratic societies governed by the parliamentary regime, freedom of expression and freedom of the press and the right to personality are the fundamental rights and freedoms regulated and protected by law. In the ideal social order, citizens are those who know their rights and freedoms and their tasks and responsibilities and use them for the well-being of themselves and of society in a way that does not harm others. The freedom of the press is the way to transmit news (events), information, ideas, thoughts and opinions to individuals and to society using various means, the way to use freedom of expression. Mass media (press-publishing bodies) perform important tasks in the name of the society, such as reporting to the society, creating the public, criticizing, interpreting and monitoring the public and the budget. Even freedom of expression and freedom of mass communication, no fundamental rights and freedom, for the sake of democracy, cannot be unlimited. Freedom of expression and freedom of public communication (including the right to news or opinion) may conflict with personal rights and personal interests. In this study, the theory of social responsibility in the context of news, news value and the conflict of the right to report-personality theory of the legal conformity of the news.
