Çocuk biyolojik ve sosyal açıdan değerlendirilerek cinsel suçların reşit olmayana karşı işlenmesi halinde diğer cinsel suçlar yönünden ayrılarak Türk Ceza Kanun’unda yerini almıştır. Mağdurun çocuk olması sebebi ile cinsel suçların hukuki anlamda boyutu tartışma konusu olmuştur. Reşit olmayanın, suçu işleyen faile karşı koyamaz bir durumda olması, bu hareketin kendisi için tehdit oluşturup oluşturmadığını bilmemesi ve yöneltilen hareketi idrak edip bu fiilin suç olduğunu algılayamaması suçu işleyenin cezalandırılmasını zorlaştıran en önemli nedenlerdendir. Çocuğun olayları anlamlandırmasındaki gerilik, sosyal ve ailevi anlamda yakınında olan kişiler tarafından suçun işlenmesi durumlarında olayın suç değil sevgiye dayalı bir davranış olduğunu düşünmesi gibi sebepler ise suçun ortaya çıkmasını ve bu tür suistimallerden kaynaklı çocuğa yöneltilen hareketleri ifa eden fail hakkında cezai soruşturma ve kovuşturmanın başlatılmasına engel olmaktadır. 2002 yılında Dünya Sağlık Örgütü, en az 150 milyon kız ve 73 milyon erkek çocuğun 18 yaşın altında zorla cinsel ilişki ya da fiziksel temas ile karşılaştığına ilişkin bilgi paylaşmıştır. Cinsel istismar suçunda tespit edilen vakaların yarısı tekrarlayıcı nitelikte yaşanan olaylardan ibarettir. Dünyada istismarın yaygınlığı ile ilgili yapılan çalışmalarda mağdurun çoğunluğunun kız çocukları olduğu açıklanmıştır. Çoğu olaylar ensest olgular içerdiğinden suçun ortaya çıkarılması neredeyse imkansızdır. Açığa çıkan cinsel istismar suçlarında verilen cezai yaptırımlara genel olarak bakıldığında; ABD ve İngiltere’de çocuğa yönelik cinsel suçlar için verilen cezaların oldukça ağırdır. Bununla birlikte Türkiye’deki cinsel suçlara ilişkin cezaların ise Avrupa ülkelerine göre daha fazla olduğunu söylemek mümkündür.

Half of the cases of sexual abuse are repeated. Studies on the prevalence of abuse in the world have revealed that the majority of the victims are girls. Because most of the events include ensest events, it is almost impossible to reveal the crime. In general, when it comes to the criminal sanctions imposed in the offense of sexual abuse, the penalties imposed for sexual crimes against children in the United States and the UK are quite severe. However, it is possible to say that the penalties for sexual crimes in Turkey are greater than the European countries.
In case the sexual offenses are committed against the minor by evaluating the child in terms of biological and social aspects, they are separated in terms of other sexual offenses and took their place in the Turkish Penal Code. As the victim is a child, the legal dimension of sexual crimes has been the subject of discussion. One of the most important reasons that makes it difficult to punish the perpetrator is that he is unable to withstand the perpetrator who is a minor and does not know whether this movement poses a threat to him or not and perceives that the act is a crime. The reasons why the child thinks that the event is a love-based behavior rather than a crime in cases where the crime is committed by people close to it in a social and family sense prevents the initiation of the criminal offense and the initiation of criminal investigation and prosecution of the perpetrator against such child abuse. .
