        Although all real and legal persons are entitled to file an application for a European Union Trademark, which is applicable as a unitary and uniform industrial property right in all of the European Union Member States, some prestigious Turkish companies act negligently to file an application for a European Union Trademark at the time when they decide to operate in the European Union market. This fact has recently caused Şenpiliç Gıda Sanayi A.Ş. to file a request for a declaration of invalidity against those of Turkish origin resident in Austria who registered “Şenpiliç” trademark, a figurative trademark, as a European Union Trademark. The request for a declaration of invalidity was based on bad faith of the trademark proprietor at the time of application, which is regulated in Article 55(1)(b) of the Regulation on European Union Trademark. The Article in question is equivalent to Article 155 of the Industrial Property Code in Turkish law. The aforementioned dispute resulted in the declaration of invalidity for the European Union Trademark, thanks to reputation of Şenpiliç Gıda Sanayi A.Ş. in Turkey. Nevertheless, this case should set a good example for the other Turkish trademarks and more Turkish companies should file an application for a European Union Trademark.
