Employers may terminate labor contract of their employees in accordance with the relevant provisions of the Labor Law no. 4857 unilaterally and the employees whose contract is terminated file a court case or go to special arbitrator. If the court or the special arbitrator rules on invalidity of termination and decide to recruitment of the employee, it is decided to pay compensation to the employee amounting up to 4 monthly wage for the period not working until the finalization of remitter decision and minimum 4 monthly and maximum 8 monthly wage for other rights and not be started to work on time. Compensation for Impediment, paid according to the Labor Law, is exempted from the income tax, while being assessed within the scope of wage according to the Income Tax Law No. 193.
