Abstract:

ÖZ İslâm Hukukunda eş nafakası, evliliğin tabii bir gereği olarak sahih evlilik akdiyle birlikte kadın lehine erkeğin mükellef kılındığı mali bir haktır. Fıkıh bilginleri, evlilik süresinde ve evliliğin sona ermesi durumunda iddet süresince nafaka yükümlüsünün erkek olduğunda ittifak etmişlerdir. Osmanlı Nafaka Kanunu’nda, Hukūk-i Âile Kararnâmesi’nde ve Sûriye Ahvâl-i Şahsiyye Kanunu’nda da bu hüküm korunmuştur. Türk Medeni Kanunu’nda ise evlilik süresindeki geçimlikte kadın-erkek eşitliği esas alınmıştır. Dolayısıyla sadece erkeğin nafaka ile mükellef kılındığına dair herhangi bir düzenleme yapılmamış, aksine maddi imkânları nispetinde kadının da ev geçimliğine katkıda bulunmasına hükmedilmiştir. Bu kanunda eş nafakası, sadece evlilik bağının çözülmesi durumunda söz konusu edilmiştir. Bu makalenin gayesi, İslâm hukuku açısından eş nafakasının, Osmanlı Nafaka Kanunu, Hukūk-i Âile Kararnâmesi, Sûriye Ahvâl-i Şahsiyye Kanunu Ve Türk Medeni Kanunu ile mukayeseli olarak incelenmesidir
