Abstract:

The basic problem of distribution of jurisdictions between judicial and administrative courts in the legal systems which are based on the separation of judicial and administrative jurisdictions, lays an important role on the courts of jurisdictional disputes where the positive regulations are not clear enough. In this article, it is tried to be determined which criteria has been used -in terms of jurisdiction-since the foundation of the Court of Jurisdictional Disputes and the different applications of those criteria in the time elapsed. Altough the heading had been planned as “The Judicial Field Criteria of Administartive Jurisdiction In the Decisions of the Court of Jurisdictional Disputes”at the begining of this article; in the face of the various and huge number of decisons some of which are diffrent from each other, the heading was changed as “(Is it possible to Determine?) The Judicial Field Criteria of Administartive Jurisdiction In the Decisions of the Court of Jurisdictional Disputes.”
