İnsanlar arasındaki çeşitli münasebetleri düzenleyen fıkıh ilminin amaçlarından biri, naslardan hareketle toplumun ihtiyaçlarına cevap verebilmektir. Tarihî süreçte ihtiyaçlara verilen cevaplar belli bir birikim oluşturmuş ve bu birikim fakihler tarafından işlenerek bir hukuk nazariyesi meydana getirilmiştir. Bu nazari birikim günümüze kadar ulaşmıştır. Bugün fıkıh alanında yapılan çalışmalarda ise sadece nazari birikim üzerinde durmamak, nazariyenin toplumdaki yansımalarını ve uygulamalarını da görmek gerekmektedir. Uygulama ve nazariye arasındaki ilişkiyi görebilmenin yolu ise bir konuyu belli bir dönem üzerinden ele almaktır. Çalışma bu ilişkiyi, son dönem Osmanlı hukukunda gasp fiilinin tezahürleri üzerinden görmeyi amaçlamaktadır. Hukuk alanında birçok değişimin yaşandığı bu dönemde gasp konusu Hanefî mezhebi çerçevesinde ele alınmıştır. Nazariyede tartışılan bu konunun uygulamada birkaç farklı şekilde tezahür ettiği, bir haksız fiil türü olan gasbın çoğu kez suç unsuruyla birlikte meydana geldiği görülmüştür. Bu sebeple gasp, borçlar hukukunun konusu olmasına rağmen, son dönem Osmanlı uygulamasında gasp ile ilgili verilere daha çok ceza mahkemelerine ait kayıtlarda rastlanmaktadır.
One of the purposes of the fictional knowledge that organizes various relationships between the people is to be able to respond to the needs of society by means of action. The responses given to the needs in the historical process have created a certain accumulation of knowledge and this accumulation has been processed by the disciples and a legal nazarya has been created. The Nazareth has reached to our day. Today, in the work in the field of fiction, it is necessary not only to stand on Nazareth accumulation, but to see the reflections and practices of Nazareth in society. The way to see the relationship between practice and Nazareth is to address a matter over a certain period of time. The study aims to see this relationship through the manifestations of the GASP facts in the last period of Ottoman law. Many changes in the law have occurred during this period in the framework of the Hanefî philosophy. This issue discussed in Nazareth appears in the practice in several different ways, and it has been seen that a misconduct, which is a kind of fact, often occurs with the element of crime. For this reason, despite the fact that Gasp is the subject of debt law, the data related to Gasp are more found in the records of the criminal courts in the last period of Ottoman application.
