Sağlık Bakanlığı 2003 yılında yayınlamış olduğu “Sağlıkta Dönüşüm” programıyla sağlık hizmetine yeni bir yön vermiştir. Bu kapsamda birinci basamak sağlık hizmetlerinin sunumu için aile hekimliği modeli öngörülmüştür. Model, 2004 yılında yürürlüğe giren 5258 sayılı “Aile Hekimliği Pilot Uygulaması Hakkında Kanun” ile uygulanmaya başlanmıştır. Bu kanuna dayanılarak çıkarılan ikincil düzenlemelerle modelin hukuki çerçevesi oluşturulmaya çalışılmıştır. Anayasa Mahkemesi ve Danıştay’ın bu mevzuata ilişkin olarak vermiş olduğu kararlar, aile hekimlerinin hukuki statüsünün tespitinde önemli rol oynamıştır. Ancak bu konudaki tartışmanın sona erdiğini söylemek zordur. İşte bu çalışmada, aile hekimlerinin hukuki statüsü, ilgili mevzuat ve yargı kararları ışığında incelenerek, önerilerde bulunulacak ve modele bir çerçeve çizilmeye çalışılacaktır.
The “Health Transformation Program” announced by the Ministry of Health in 2003 gave healthcare services a new direction. In this context, the first step foreseen was the family physicians model for the delivery of primary healthcare services. Implementation of the model commenced with the introduction of Law No. 5258 on the Pilot Implementation of Family Medicine which came into force in 2004. The secondary legislation adopted pursuant to this law has attempted to create the legal framework for the model. Decisions of the Supreme Court and the Council of State regarding this legislation is that it has played an important role in determining the legal status of family physicians. However, it is difficult to say that discussions on this issue have come to an end. This study aims to put forward suggestions and provide a framework for the model through examining the legal status of family physicians in light of relevant legislation and judicial decisions
