John Stuart Mill (1806-1873) faydacı felsefenin Jeremy Bentham ile birlikte en iyi bilinen üyelerinden biri olmuştur ve klasik liberal düşünce için de anahtar bir figürdür. Liberalizm ile faydacılık arasındaki ilişki daima belli bir karmaşıklık içinde nitelendirilir ve problemli bağlantı iki dikkat çekici kavram, fayda ve özgürlüğün etkisi altında kendini gösteren Mill’in felsefesinde de doğal olarak yansımasını bulur. Fakat yine bu bağlantının netameli doğası sayesinde Mill’in felsefesi güncel hukuk teorisi tartışmaları için önemli bir kaynak halini alır; özellikle de bireysel özgürlüğün sınırları, hukuki ahlakçılık ve hukuki paternalizm ile ilgili olarak. Bu makalede Mill’in hukuk felsefesine yapmış olduğu bu katkılar ele alınıp irdelenecektir.
John Stuart Mill (1806-1873) was one of the best-known members of useful philosophy along with Jeremy Bentham and is also a key figure for classical liberal thinking. The relationship between liberalism and utility is always defined in a certain complexity, and the problematic connection finds itself naturally reflected in the Philosophy of Mill, which manifests itself under the influence of two remarkable concepts of utility and freedom. But again, thanks to the pure nature of this connection, Mill’s philosophy becomes an important source for current legal theory discussions, especially in relation to the limits of individual freedom, legal morality and legal paternalism. In this article, the contribution that Mill has made to the law philosophy will be discussed and discussed.
