Türk kanun koyucusu, Almanya, Belçika, Avusturya gibi Türk vatandaşlarının yoğun olduğu ülkelerde yaşayan ve çıkma izni almak suretiyle Türk vatandaşlığından ayrılan kişilerin, bazı istisnalar dışında, Türk vatandaşı gibi muamele görmesine imkân veren bir düzenleme yapma ihtiyacı duymuştur. Bu amaçla, ilk kez 1995 yılında yapılan yasal düzenleme daha sonra uygulamada görülen sorunlar ve ihtiyaçlar doğrultusunda 2004, 2009 ve 2012 yıllarında değiştirilmiştir. Kabul edilen bu düzenlemeler ile mavi kartlılar adını verdiğimiz özel statülü yabancı grubu yaratılmış ve mavi kart hamillerinin sahip olduğu/ olmadığı haklar belirtilmiştir. Ancak uygulamada konuya ilişkin sorunlar devam etmektedir. Bu sorunların temel nedeni ise pozitif düzenlemede yer alan “…Türk vatandaşlarına tanınan haklardan aynen yararlanırlar” ifadesinin yorumundaki farklılıklardır. Bu durumun yarattığı sorunları gidermenin en iyi yolu ise bu hükümde revizyona gidilmesi veya mavi kart hamillerinin durumunun özel olarak düzenlenmesidir.
The Turkish lawmaker, Germany, Belgium, Austria and other countries where Turkish citizens are intense, has needed to make a regulation that allows persons withdrawed from Turkish citizenship by obtaining a leave permit to be treated as Turkish citizens, except for some exceptions. For this purpose, the legislation was first amended in 1995 and was subsequently amended in 2004, 2009 and 2012 in accordance with the problems and needs seen in application. With these accepted regulations, we have created a special status foreign group that we call blue cards and the rights of pregnant blue cards are specified. However, the problems with the subject continues. The main cause of these problems is the differences in the interpretation of the phrase "they enjoy the rights recognized to Turkish citizens" in the positive arrangement. The best way to solve the problems that this situation creates is to go to the review of this provision or to specially regulate the condition of the pregnant blue card.
The Turkish legislature needs to enact a regulation that would allow Turkish nationals living in countries with significant populations of Turkish citizens, such as Germany, Belgium, and Austria, to continue to be treated like Turkish citizens, although with some exceptions for those who renounced their citizenship when obtaining their permission to leave Turkey. To address this, a regulation was placed into effect for the first time in 1995 and amended in t 2004, 2009, and 2012 in response to changes in factual circumstances related to the regulation. With the promulgation of these regulations, a special foreigner status group, termed blue cardholders, was created and purportedly defined the rights of the blue cardholders. However, in practice, the problems remain to be resolved. The main reason for these problems is the difference in the interpretation of the broad but ambiguous statement “they enjoy the same rights that are given to Turkish citizens” in the positive regulation. The best way to solve the problems created by this situation is to revise this provision to regulate the status and rights of blue cardholders with specificity.
