Abstract:

The worldwide Covid-19 epidemic, which has been ongoing for more than a year, forces the states to take unprecedented measures, along with full closures, travel ban, additional visa requirements, restrictions and ban on the import and export of medical products, the privatization of health services, the slowdown of projects, such measures inevitably affect foreign direct investments. The measures taken by States in the process of fighting the epidemic will be able to raise claims of violation of international investment agreements and these claims will be able to be raised against States before the institutional arbitration mechanisms, which operate in order to ensure the resolution of disputes arising from the obstacles that the cross-border commercial activities of investors face at national level by independent and neutral judicial bodies. The effect of national measures taken in the new period to combat the Covid-19 epidemic and affecting foreign direct investments on the legal system on the resolution of international investment disputes is important.
