Esas olarak anayasa ve idare hukuku alanında ele alınan “kamu görevlisi” kavramı, TCK m 6/1-c’de tanımlanan ve ceza hukuku açısından ayrıca irdelenmesi gereken bir hukuki kavramdır. Kanun koyucunun belli suçlarda tipik hareketi, kişinin kamu görevlisi sıfatına özgüleyerek tanımlamayı tercih etmesi, kamu görevlisi kavramının ceza hukuku boyutuyla doğru şekilde tespit edilmesini daha zorunlu kılmaktadır. Özgü suç özelliği gösteren bu tip suçlara iştirak edilmesi halinde, özel faillik niteliğini taşıyan kişiler ile özel faillik niteliğini taşımayanlar bakımından; başka deyişle, kamu görevlisi olan ve kamu görevlisi olmayan suç ortakları açısından ne gibi hukuki sonuçların ortaya çıktığı titizlikle incelenmelidir. Diğer yandan, kamu görevlisi olan fail tarafından ya da kamu görevlisine karşı yerine getirdiği kamu görevi sebebiyle gerçekleştirilen davranış, bazı suçlar açısından cezayı artıran nitelikli hal özelliği gösterir. Bu şekilde öngörülen cezai normun iştirak ilişkisi içinde ihlali durumunda, suçun nitelikli hallerinin fail ve şerike sirayeti meselesi analiz edilmeli, kamu görevlisi sıfatının suç ortaklarının cezai sorumluluğuna etkisi belirlenmelidir.
The concept of "public officer", which is mainly handled in the field of constitutional and administrative law, also defined in Article 6/1-c of the Turkish Penal Code is a legal concept should be examined separately in terms of criminal law. The fact that the lawmaker prefers to define the typical act in certain crimes by attributing the person’s title as a public officer makes it more compulsory to determine the concept of public officer correctly with the dimension of criminal law. In case of complicity in peculiar crimes, in terms of individuals those who are eligible to be a perpetrator of a peculiar offence and those who do not eligible to be a perpetrator of a peculiar offence; in other words, for accomplices who are public officers and who are not public officers, what kind of legal consequences arise should be examined carefully. On the other hand, the acts committed by the perpetrator who is a public officer or the acts committed against a public officer due to his / her public duty, necessitates the aggravation of the sentence in terms of some crimes. In case of violation of such a criminal norm within the complicity, the impact of qualified cases to the perpetrator, and the participator should be analyzed, and the effect of the title of public officer on the criminal responsibility of the accomplices should be determined
