Suçsuzluk karinesi, ceza muhakemesinin her evresinde gözetilen bir temel haktır. Suçsuzluk karinesi, ceza muhakemesinde adil yargılanmanın gerçekleştirilmesini sağlamaktadır. Genel olarak, kamu görevlilerinin görevleriyle bağlantılı olarak işledikleri iddia edilen suçlarla ilgili ihbar ve şikâyetler bakımından özel bazı hükümlerin bulunduğu görülmektedir. Söz konusu hükümler kamu görevlilerini haksız isnatlardan korumayı amaçlamaktadır. Soruşturma yapılmasına yer olmadığı kararıyla, bu koruma mekanizmasının kamu görevlisi olmayan kişiler bakımından da getirilmesi hedeflenmiştir. Bu çalışmada hukukumuzda yeni bir karar türü olarak soruşturma yapılmasına yer olmadığı kararı incelenecektir. Konu incelenirken öncelikle hukukumuzda ihbar ve şikâyete ilişkin genel bilgiler verilecektir. Daha sonra Avrupa İnsan Hakları Mahkemesi’nin suçsuzluk karinesiyle ilgili kararları değerlendirilecektir. Son bölümde ise 5271 sayılı Ceza Muhakemesi Kanunu’na eklenen düzenlemeyle soruşturma yapılmasına yer olmadığı kararının koşulları incelenecektir. Ayrıca getirilen yeni kanuni düzenlemeyle ilgili eleştiri ve önerilere yer verilecektir.
The presumption of innocence is a fundamental right at every stage of criminal proceedings. The presumption of innocence ensures fair trial in criminal proceedings. In general, there are some specific provisions regarding the denunciations and complaints related to the alleged crimes in connection with the duties of public officials. These provisions aim to protect public officials from unjustified charges. With the decision of non-investigation, it is aimed at bringing this protection mechanism in terms of non-public officials. In this study, the decision of non-investigation as a new type of decision in our law will be examined. When examining the subject, general information about denunciation and complaint in our law will be given first. The decisions of the European Court of Human Rights regarding the presumption of innocence will then be evaluated. In the last section, with the amendment to the Code of Criminal Procedure No. 5271, the conditions of the decision of non-investigation will be examined. Furthermore, criticisms and suggestions regarding the new legal regulation will be included.
