6771 sayılı Kanunla, Türk hükümet sistemi Cumhurbaşkanlığı sistemi olarak değişmiştir. Cumhurbaşkanlığı sisteminde, başkanlık sistemine ilişkin belirleyici noktalar bulunmakla birlikte, sistemin Türkiye’ye özgü yönleri de bulunmaktadır. Cumhurbaşkanı hem devlet başkanlığı hem de hükümet başkanlığı yetki ve görevlerini bünyesinde toplamaktadır. Bu bakımdan, parlamenter sistemdeki yetkisiz ve sorumsuz devlet başkanından farklı bir konumu bulunmaktadır. Cumhurbaşkanın sorumluluğu siyasi, hukuki ve cezai olmak üzere üç açıdan değerlendirilmelidir. Yine bu sorumluluk kişisel ve göreviyle ilgili boyutlarıyla birbirinden ayrılarak incelenmelidir. Başkanlık sistemi sert güçler ayrılığı sistemi olduğu için başkanın sorumluluğu yolunun işletilmesinde yasamanın konumu önemlidir. Buna göre yasamanın yürütme ile ilişkisi bağlamında sert güçler ayrılığının mantığına uygun bir sorumluluk sürecinin anayasal zemine kavuşturulması gerekir. Bu çalışmada, 6771 sayılı kanunla Anayasa’da yapılan değişikliğin Cumhurbaşkanının sorumluluğunun kapsamını ne şekilde belirlediği, önceki düzenleme ile karşılaştırılmaktadır.
With the Law No. 6771, the Turkish government system has changed as the presidential system. In the Turkish presidential system have specific aspects to Turkey though there are some significant points about the presidential system. The President collects both the powers and duties of the head of state and the head of government. In this regard, there is a different situation from the unauthorized and irresponsible president in the parliamentary system. The responsibility of the President is to be assessed in three respects: political, legal and criminal. Moreover, this responsibility should be examined after separation of personal and task-related dimensions. The position of the parliament is crucial for checking the president in the presidential system that system of a hard separation of powers. In this regard, an accountability process should bring to the appropriate constitutional stage through the logic of the hard separation of powers. In this study, how the amendment of the Constitution with the Law No. 6771 determines the scope of the President's responsibility has compared with the previous regulation.
