Kişilerden kan ve doku örneği alınması, hem kişilerin vücut bütünlüğü hem de soybağı tespit edilecek kişi açısından son derece önemli bir işlemdir. Bu öneminden dolayı, bu işlem hem Türk Medenî Kanunu hem de Hukuk Muhakemeleri Kanunu tarafından özel olarak düzenlenmiş olmakla birlikte iki Kanun farklı nitelikte düzenlemeler içermektedir. İki Kanun arasındaki farklılık hem doktrin hem de yargı kararlarında farklı şekilde yorumlanmaktadır. Söz konusu yorum farkı ise uygulamada tereddütlere yol açmaktadır. Çalışmamızın amacı da, kanunkoyucunun amacını da dikkate alarak kişilerden kan ve doku örneği alınması hususunda uygulama alanı bulması gereken hukuk kuralını tespit etmektir. Bu kapsamda öncelikle doktrin görüşleri değerlendirilmiş ve Yargıtay’ın konu ile ilgili kararları irdelenmiştir. Çalışma kapsamında ayrıca Alman ve İsviçre hukuklarında bulunan düzenlemeler de ayrı bir başlık altında incelenmiştir. Çalışmanın sınırı medenî yargılama hukuku ile sınırlı tutulmuş, gerektiği ölçüde ceza yargılaması hukuku ile karşılaştırma yapılmıştır.
Taking blood and tissue samples from individuals is an extremely important process for both the integrity of the body of individuals and the person to be identified. Due to this importance, this procedure is specially regulated by both the Turkish Civil Law and the Law on Legal Procedures, while the two laws contain different regulations. The differences between the two laws are interpreted differently in both the doctrine and judgment decisions. The discrepancy in the practice leads to doubt. The purpose of our study is to identify the legal rule that the lawmaker should find the area of application in the matter of taking blood and tissue samples from individuals, taking into account the purpose of the lawmaker. In this context, the doctrine opinions were first evaluated and the judgment of the court on the subject was examined. In the framework of the study, the regulations in the German and Swiss law were also examined under a separate title. The limit of the work is limited to the law of civil trial, compared to the law of criminal trial to the extent necessary.
Collecting blood and body tissue samples from individuals is a crucial process for both the body integrity of the individuals and the person whose paternity will be established. As a result of this importance, this procedure has been specially legislated by both the Turkish Civil Code and the Code of Civil Procedure, but these two Codes contain different provisions. This difference between two Codes is interpreted differently in both doctrine and jurisprudence. The difference of interpretation causes hesitations in practice. The purpose of this study is to determine the applicable law for taking blood and tissue samples from individuals, by considering the purpose of the lawmaker. In this context, primarily the arguments of the doctrine are evaluated and the decisions of the Supreme Court on the subject are examined. Within the scope of the study, the provisions in German and Swiss law are also taken into consideration under a separate heading. The scope of this study is limited to civil procedure law and a comparison is made with criminal procedure law as it is necessary.
