Abstract:

Legal personality is a structure that is born out of social needs in order to enable people to achieve certain goals, and then given personality by the legal order. The concept of legal personality in law is a relatively new phenomenon. In the classical doctrine of Islamic law, there is no concept or section on legal personality. However, modern jurists have been working on the idea that some of the institutions existing in Islamic law are manifestations of legal personality. No study has been found in which these institutions are analysed by considering the criteria of legal personality. In this study, a general perspective on legal personality is presented, the institutions that are the appearance of legal personality in Islamic law are evaluated by taking the elements of legal personality as criteria, and thus the question "Is there legal personality in Islamic law?" will be tried to be answered.
